NARA Probationary Class Appeal Update

by | Aug 1, 2025 | Firm News

Earlier this year we filed a request for a class appeal with the MSPB on behalf of probationary employees illegally fired from the National Archives and Records Administration (NARA).

Following our appeal on behalf of the terminated employees, NARA began rescinding its illegal terminations and started the process to reinstate those employees.

Due to NARA reversing course and returning employees to work, on July 31, 2025, the MSPB dismissed the request to address the agency’s terminations as a class, where many employees have now been provided the relief to which they would have been entitled under our appeal.

If you are a NARA employee illegally terminated during your probationary period earlier this year, but your removal has not been fully rescinded, and you have not been returned to your duties and provided back pay and benefits, please note that you have until September 4, 2025, to file your own individual appeal with the MSPB. See 5 C.F.R. §1201.27(b).
