On May 8, 2025, Gilbert Employment Law, P.C. filed a class appeal with the Merit Systems Protection Board (MSPB) on behalf of all U.S. Office of Personnel Management (OPM) employees subject to separation from the federal service by a Reduction-in-Force (RIF) since January 20, 2025. On June 16, 2025, the MSPB denied our request for class certification. This means that OPM employees separated pursuant to a RIF will now have to file an individual appeal with the MSPB if they wish to challenge their separation.
For OPM employees separated prior to June 16, 2025, the deadline to file an individual appeal with the MSPB is Monday, July 21, 2025.
For OPM employees separated on or after June 16, 2025, the deadline to file an individual appeal with the MSPB is 30 days following the effective date of the employee’s separation.
