Following our request for a class appeal on the administration’s mass termination of probationary employees earlier this year, the U.S. Department of Energy undertook efforts to walk back its illegal actions and return civil servants to work.
In light of that large-scale return to work, on May 30, 2025, the MSPB dismissed the request to address the agency’s terminations as a class, where many employees have now been provided the relief to which they would be entitled under our appeal.
If you are a Department of Energy employee illegally terminated during your probationary period earlier this year, but your removal has not been fully rescinded, and you have not been returned to your duties and provided back pay and benefits, please note that you have until July 4, 2025, to file your own individual appeal with the MSPB. See 5 C.F.R. §1201.27(b).
